Introduction

These Terms and Conditions govern vehicle rentals provided by EZ Rentals Pty Ltd ("EZ Rentals", "we", "our", or "us").

By booking, paying for, collecting, or operating a Vehicle supplied by EZ Rentals, you agree to these Terms and Conditions and the applicable Rental Agreement.

1. Definitions And Interpretation

In these Terms and Conditions, unless the context otherwise requires:

"Authorised Driver" means the Renter and any additional driver listed on the Rental Agreement who meets our eligibility criteria and has been approved by EZ Rentals in writing.

"Business Day" means a day other than a Saturday, Sunday, or public holiday in the state or territory where the Vehicle is collected.

"Business Hours" means 8:00 am to 5:00 pm local time on Business Days.

"Excess" means the amount you must pay towards any claim for loss or damage to the Vehicle or Third Party Property, as specified in the Rental Agreement and subject to any Excess Reduction product purchased.

"Excess Reduction" or "LDW" (Loss Damage Waiver) means an optional product that reduces the Excess amount payable in the event of an incident, subject to the terms and conditions of that product.

"Force Majeure Event" means any event beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, industrial action, or supply chain disruptions.

"Permitted Area of Use" means the geographic area in which the Vehicle may be operated as specified in clause 4.2 and the Rental Agreement.

"Rental Commencement" means the date and time specified in the Rental Agreement when the rental period begins.

"Rental Period" means the period from Rental Commencement until the Vehicle is returned to us and inspected by our representative, or until the time specified in the Rental Agreement, whichever is later.

"Renter" or "you" means the person or entity named as the renter in the Rental Agreement.

"Third Party Property" means property belonging to any person other than EZ Rentals, the Renter, or an Authorised Driver.

"Vehicle" means the motor vehicle described in the Rental Agreement, including all tyres, tools, accessories, and equipment supplied with it.

By booking, paying for, collecting, or operating a vehicle supplied by EZ Rentals, you agree to these Terms and Conditions.

1.1 Consumer Guarantees

These Terms and Conditions do not exclude, restrict, or modify the application of any provision of the Australian Consumer Law (ACL), including the consumer guarantees set out in Division 1 of Part 3-2 of the Competition and Consumer Act 2010 (Cth). To the extent that any term of these Terms and Conditions is inconsistent with the ACL, the ACL will prevail.

2. Eligibility And Driver Requirements

2.1 To enter into a Rental Agreement, you must:

  1. (a) be at least 21 years of age at the time of Rental Commencement;
  2. (b) hold a current, valid, and unrestricted Australian driver's licence, or a valid international driver's licence accompanied by a valid passport from the country of issue, for the entire Rental Period;
  3. (c) have held that licence for a minimum of 12 months (or 24 months for high-performance or commercial vehicles, as specified in the Rental Agreement);
  4. (d) provide a valid passport or other government-issued photo identification for verification purposes;
  5. (e) present a valid credit or debit card in your own name for payment and bond authorisation; and
  6. (f) meet our insurance and verification requirements, including any credit or identity checks we deem necessary.

2.2 Young Driver Surcharge

Drivers aged 21 to 24 years (inclusive) may be subject to a Young Driver Surcharge, as specified in the Rental Agreement and current price list. This surcharge reflects the increased insurance risk associated with younger drivers and is not negotiable.

2.3 Additional Drivers

Any person other than the Renter who will operate the Vehicle must be listed as an Authorised Driver on the Rental Agreement. Each Authorised Driver must meet the eligibility criteria in clause 2.1 and may be subject to an additional driver fee. The Renter remains fully liable for the acts and omissions of all Authorised Drivers.

2.4 Refusal of Service

EZ Rentals reserves the right to refuse service at its discretion, including but not limited to circumstances where:

  1. (a) we are unable to verify your identity or licence validity;
  2. (b) you have previously breached a rental agreement with us or an affiliate;
  3. (c) you have an outstanding debt to EZ Rentals;
  4. (d) you present a credit or debit card that is declined or invalid; or
  5. (e) we reasonably believe that providing the Vehicle would create an unacceptable risk to safety, property, or insurance coverage.

Our decision to refuse service is final and not subject to appeal.

3. Rental Period And Return

3.1 Commencement and End

The Rental Period commences at the date and time specified in the Rental Agreement ("Rental Commencement") and ends when:

  1. (a) the Vehicle is returned to the location specified in the Rental Agreement;
  2. (b) the Vehicle has been inspected by our representative or, in the case of after-hours return, secured in our designated return area with keys deposited as instructed; and
  3. (c) a final condition report has been completed or, for after-hours returns, our inspection is completed on the next Business Day.

3.2 Late Return Charges

If you return the Vehicle after the agreed return time specified in the Rental Agreement, you will be charged:

  1. (a) an additional day's rental at the daily rate specified in the Rental Agreement for each full or partial 24-hour period (or part thereof) by which the return is delayed; and
  2. (b) a late return administrative fee

of $50.00 per day (or part thereof), provided that this fee reflects our reasonable costs of managing the late return and does not exceed our actual loss.

3.3 Extension of Rental Period

You may request an extension of the Rental Period by contacting us before the agreed return time. Extensions are subject to Vehicle availability and may be subject to additional charges. If you fail to return the Vehicle by the agreed time and have not obtained an extension, we may report the Vehicle as stolen to police and you will be liable for all costs associated with recovery.

3.4 After-Hours Return

If after-hours return is permitted, the Vehicle must be left in our designated return area with all doors locked, keys deposited in the secure key drop as instructed, and all personal property removed. You remain liable for the Vehicle until our opening Business Hours on the next Business Day.

4. Vehicle Use And Permitted Area

4.1 Prohibited Use

The Vehicle must not be used:

  1. (a) for racing, speed testing, or competitions of any kind;
  2. (b) for any illegal purpose;
  3. (c) while the driver is under the influence of alcohol, drugs, or any substance that impairs driving ability, including prescription medication where the label or a medical practitioner advises against driving;
  4. (d) by any person who is not an Authorised Driver;
  5. (e) to transport dangerous goods, hazardous materials, or substances classified as dangerous under the Australian Dangerous Goods Code, unless expressly

authorised in writing by EZ Rentals and the Vehicle is appropriately licensed and equipped for such transport;

  1. (f) to tow any vehicle, trailer, caravan, or boat unless expressly authorised in writing by EZ Rentals and the Vehicle is equipped with an approved tow bar and the towed item does not exceed the manufacturer's specified towing capacity;
  2. (g) to carry more passengers than the number of seat belts fitted in the Vehicle;
  3. (h) to carry goods that exceed the Vehicle's payload or load capacity;
    1. (i) for rideshare, taxi, or delivery services (including but not limited to Uber, Lyft, DoorDash, Uber Eats) unless the Rental Agreement specifically authorises commercial use; or
  4. (j) in any manner that would void the Vehicle's insurance or warranty.

4.2 Permitted Area of Use

Unless otherwise authorised in writing by EZ Rentals, the Vehicle may only be operated within:

  1. (a) the state or territory of Rental Commencement;
  2. (b) on sealed, public roads suitable for the Vehicle type;
  3. (c) within the geographic boundaries specified in the Rental Agreement; and
  4. (d) excluding any area designated by us as prohibited due to insurance exclusions, seasonal conditions, or safety concerns (including but not limited to unsealed roads in remote areas, flood-prone zones, snow chains required areas, and islands not connected to the mainland by bridge).

4.3 Interstate and Remote Travel

Travel outside the state or territory of Rental Commencement, or to remote or regional areas, requires prior written authorisation from EZ Rentals. We may require additional insurance coverage, a higher bond, or specific Vehicle preparation for such travel. Failure to obtain authorisation may void insurance coverage and result in immediate termination of the Rental Agreement.

4.4 Unsealed Roads

Unless the Rental Agreement specifically authorises off-road or unsealed road use, the Vehicle must not be operated on unsealed, gravel, dirt, or unformed roads. Damage sustained on unsealed roads is not covered by our insurance and will be your financial responsibility in full.

4.5 Smoking and Pets

Smoking (including vaping, e-cigarettes, and the use of any smoking device) is strictly prohibited in all Vehicles. A cleaning and deodorising fee of minimum $250.00 will apply for any breach of this prohibition.

Animals are not permitted in Vehicles except for registered assistance animals under the Disability Discrimination Act 1992 (Cth). You must notify us at the time of booking if you will be travelling with an assistance animal. A cleaning fee of minimum $150.00 will apply for any unauthorised pet hair, odour, or damage.

5. Traffic Infringements And Tolls

5.1 Renter Liability

You are solely responsible for:

  1. (a) all speeding fines, parking fines, and other traffic infringement notices issued during the Rental Period;
  2. (b) all toll charges incurred during the Rental Period, including tolls charged via electronic tolling systems (e.g., e-TAG, Linkt) and any toll operator administrative fees; and
  3. (c) any demerit points or licence penalties arising from your use of the Vehicle.

5.2 Administrative Fee

We charge an administrative fee of $25.00 per infringement notice or toll charge processed on your behalf. This fee reflects our reasonable costs of administering, recording, and forwarding infringement notices to you and does not exceed our actual administrative costs. We will provide you with a copy of the infringement notice and a breakdown of the fee upon request.

5.3 Payment Timing

You must pay all fines, tolls, and administrative fees within 14 days of our invoice or, if earlier, before the due date specified on the infringement notice. If you fail to pay on time, we may charge the outstanding amount to your nominated payment method, including any late payment fees or interest as specified in clause 9.

5.4 Toll Device

If the Vehicle is fitted with an electronic tolling device, you must not interfere with, remove, or disable it. You are responsible for all tolls charged to that device during the Rental Period.

6. Damage, Accidents, And Incident Reporting

6.1 Immediate Notification

You must notify EZ Rentals by telephone on 0406 434 303, or another incident contact number specified in the Rental Agreement or published on ezrentals.com.au/contact, as soon as practicable after the incident and, where reasonably possible, within 2 hours. Safety and emergency assistance must take priority where immediate notification is not possible.

6.2 Police Notification

You must notify the police and obtain a police report number for any incident involving:

  1. (a) injury to any person;
  2. (b) damage to Third Party Property;
  3. (c) theft or attempted theft of the Vehicle or its contents;
  4. (d) malicious damage or vandalism; or
  5. (e) any incident where the other party fails to stop or exchange details.

6.3 Incident Information

You must provide us with the following information within 24 hours of the incident:

  1. (a) date, time, and location of the incident;
  2. (b) names, addresses, phone numbers, and licence details of all parties involved;
  3. (c) registration numbers and insurance details of all vehicles involved;
  4. (d) police report number (if applicable);
  5. (e) names and contact details of any witnesses;
  6. (f) photographs of the damage, scene, and all vehicles involved; and
  7. (g) a written statement describing the incident.

6.4 Cooperation with Insurers

You must cooperate fully with our insurers, loss adjusters, and investigators, including providing statements, attending interviews, and producing documents as reasonably required. You must not admit liability, negotiate settlement, or agree to any payment to third parties without our prior written consent.

6.5 Failure to Report

If you materially fail to report an incident as required by this clause, or knowingly provide false or misleading information, and that failure causes or increases loss or prejudices an insurance claim:

  1. (a) you may be liable for the loss reasonably resulting from that failure;
  2. (b) an Excess Reduction or LDW product may be unavailable to the extent permitted by its terms and applicable law; and
  3. (c) we may terminate the Rental Agreement and recover the Vehicle where the breach is serious or deliberate.

6.6 Claims Administration Fee

In the event of an insurance claim, we charge a claims administration fee of $100.00 per claim. This fee reflects our reasonable costs of processing the claim, liaising with insurers, and managing repairs, and does not exceed our actual administrative costs.

7. Insurance And Excess

7.1 Standard Insurance Coverage

All Vehicles are insured for the Rental Period against:

  1. (a) damage to the Vehicle caused by collision, fire, theft, vandalism, or other insured events, subject to the Excess specified in the Rental Agreement;
  2. (b) Third Party Property damage up to the limit specified in our insurance policy; and
  3. (c) liability for personal injury to third parties as required by compulsory third party insurance legislation in the relevant state or territory.

7.2 Excess

The Excess is the amount you must contribute towards any insurance claim for damage to the Vehicle or Third Party Property. The standard Excess amount is specified in the Rental Agreement and current price list. The Excess applies per incident, not per Rental Period.

7.3 Excess Reduction (Loss Damage Waiver)

We offer an optional Excess Reduction product ("LDW") that reduces the Excess amount payable in the event of an incident. LDW terms, conditions, and pricing are available upon request and will be specified in the Rental Agreement if purchased. LDW does not cover:

  1. (a) damage caused by breach of clause 4 (Prohibited Use);
  2. (b) damage to tyres, wheels, windscreens, and underbody unless the specific "Premium LDW" product is purchased;
  3. (c) loss of keys or remote locking devices;
  4. (d) damage caused by driving under the influence of alcohol or drugs;
  5. (e) damage caused by an unauthorised driver; or
  6. (f) personal property left in the Vehicle.

7.4 At-Fault and Not-At-Fault Incidents

  1. (a) If you are at fault in an incident, the full Excess (or reduced Excess if LDW is purchased) applies.
  2. (b) If you are not at fault and can provide the full details of the at-fault party (including name, address, phone number, registration number, and insurer), and the at-fault party's insurer accepts liability, the Excess may be waived or refunded, subject to our insurer's confirmation.
  3. (c) If you are not at fault but cannot identify the at-fault party, the Excess applies unless you have purchased LDW.

7.5 Exclusions from Insurance

You will be liable for the full cost of repair or replacement (as applicable) for damage arising from:

  1. (a) breach of any term of these Terms and Conditions or the Rental Agreement;
  2. (b) use of the Vehicle outside the Permitted Area of Use;
  3. (c) operation on unsealed roads (unless authorised);
  4. (d) failure to report an incident as required by clause 6;
  5. (e) water damage, including but not limited to flood, river crossing, or tidal inundation;
  6. (f) overhead damage, including but not limited to damage from low- clearance structures, car parks, branches, or awnings;
  7. (g) underbody damage, including but not limited to damage from speed bumps, potholes, or off-road use;
  8. (h) tyre damage caused by driving on flat or damaged tyres;
  9. (i) damage caused by incorrect fuel type; or
  10. (j) any other exclusion specified in our insurance policy.

7.6 Key Replacement

If Vehicle keys or remote locking devices are lost, stolen, or damaged during the Rental Period, you are liable for the full cost of replacement and reprogramming, which may exceed $500.00 depending on the Vehicle model. This is not covered by standard insurance or LDW.

7.7 Personal Property

Our insurance does not cover personal property left in or stolen from the Vehicle. We strongly recommend you remove all personal property at the end of each journey and do not leave valuables in the Vehicle overnight.

8. Security Deposit (Bond)

8.1 Bond Amount

A security bond is required for all rentals. The bond amount is specified in the Rental Agreement and is determined by the Vehicle type, Rental Period, driver age, and any risk factors identified during booking. The bond will be held as a pre-authorisation on your nominated credit or debit card at Rental Commencement.

8.2 Bond Release Process

  1. (a) We will inspect the Vehicle within 2 Business Days of return (or next Business Day for after-hours returns).
  2. (b) If no damage, cleaning, fuel shortage, tolls, infringements, or outstanding charges are identified, the full bond will be released within 5 Business Days of return.
  3. (c) If deductions are required, we will provide you with an itemised statement of deductions within 5 Business Days of return, including:
    1. (i) the nature and amount of each deduction;
    2. (ii) photographic evidence where applicable;
    3. (iii) receipts or quotes for repair or cleaning costs; and
    4. (iv) the remaining balance to be refunded.
  4. (d) The balance of the bond will be refunded within 5 Business Days of providing the itemised statement.

8.3 Deductions from Bond

We may deduct from the bond:

  1. (a) repair costs for damage to the Vehicle, including labour, parts, and loss of use (calculated at the daily rental rate for the period the Vehicle is unavailable for hire);
  2. (b) cleaning costs exceeding fair wear and tear, including smoke deodorising, pet hair removal, and stain treatment;
  3. (c) fuel replacement costs at a rate of $2.50 per litre (or current market rate, whichever is higher) plus a $25.00

refuelling service fee;

  1. (d) tolls, infringements, and associated administrative fees;
  2. (e) late return charges;
  3. (f) any other outstanding amounts due under the Rental Agreement.

8.4 Bond Disputes

If you dispute any deduction from the bond, you must notify us in writing within 14 days of the itemised statement. We will review your dispute and provide a written response within 14 days. If we cannot resolve the dispute, clause 16 (Dispute Resolution) applies.

8.5 No Cash Bonds

We do not accept cash bonds. All bonds must be held by pre-authorisation on a valid credit or debit card.

9. Fuel Policy

9.1 Fuel Level at Commencement

The fuel level at Rental Commencement will be recorded on the Rental Agreement and verified by both parties. Most Vehicles are supplied with a full tank. If the Vehicle is supplied with less than a full tank, the specific level (e.g., half, three-quarters) will be recorded.

9.2 Return Requirement

You must return the Vehicle with the same fuel level as at Rental Commencement, measured by the fuel gauge. Minor variations of up to 1/8 of a tank will be accepted at our discretion without charge.

9.3 Refuelling Charges

If the Vehicle is returned with less fuel than supplied, we will charge:

  1. (a) fuel replacement at a rate of $2.50 per litre (or current market rate, whichever is higher); and
  2. (b) a refuelling service fee of $25.00.

These charges reflect our reasonable costs of refuelling and do not exceed our actual costs.

9.4 Pre-Purchase Fuel Option

We may offer a pre-purchase fuel option allowing you to return the Vehicle with any fuel level. This option, if available, will be specified in the Rental Agreement and is non-refundable.

10. Cleaning And Fair Wear And Tear

10.1 Return Condition

You must return the Vehicle in a clean and tidy condition, free of rubbish, food waste, and personal property. "Fair wear and tear" means the reasonable deterioration that occurs during normal use of the Vehicle, including minor dust, small scuff marks, and light interior soiling that can be removed by standard vacuuming and washing.

10.2 Cleaning Fees

The following cleaning fees apply for conditions exceeding fair wear and tear:

  1. (a) Standard cleaning (interior vacuum, exterior wash, rubbish removal): $75.00;
  2. (b) Deep cleaning (stain removal, deodorising, excessive dirt): $150.00;
  3. (c) Smoke or vaping residue (interior deodorising, surface treatment): $250.00 minimum;
  4. (d) Pet hair or unauthorised animal presence: $150.00 minimum; and
  5. (e) Biohazard or bodily fluids: $500.00 minimum (plus any specialist disinfection costs).

10.3 Evidence and Itemisation

We will photograph the condition of the Vehicle at return and provide you with photographic evidence and itemised invoices for any cleaning charges. You may request to be present during the return inspection.

10.4 Prohibited Substances

You must not use any adhesive materials, paint, or permanent markers in or on the Vehicle. You must not attach any items to the Vehicle using adhesive, magnets, or fixtures that may damage paint or surfaces.

11. Termination Of Rental Agreement

11.1 Immediate Termination

We may terminate the Rental Agreement immediately and recover the Vehicle without prior notice if:

  1. (a) you breach any material term of these Terms and Conditions or the Rental Agreement;
  2. (b) we reasonably suspect fraud, misrepresentation, or identity theft;
  3. (c) the Vehicle is used for an unlawful purpose;
  4. (d) the Vehicle is operated by an unauthorised driver;
  5. (e) the Vehicle is used outside the Permitted Area of Use without authorisation;
  6. (f) you fail to pay any amount when due and do not remedy the breach within 24 hours of notice;
  7. (g) you abandon the Vehicle or fail to return it by the agreed time without obtaining an extension; or
  8. (h) we reasonably believe that continuation of the rental poses a risk to safety, property, or insurance coverage.

11.2 Notice and Cure Period

For non-material breaches (other than those in clause 11.1), we will provide you with written notice specifying the breach and a reasonable cure period (of not less than 24 hours) before terminating the Rental Agreement.

11.3 Consequences of Termination

Upon termination:

  1. (a) you must immediately return the Vehicle to the location specified by us;
  2. (b) you remain liable for all rental charges up to the date of return;
  3. (c) you remain liable for any damage, cleaning, tolls, infringements, or other charges incurred up to the date of return;
  4. (d) the full Excess applies to any damage regardless of LDW purchase; and
  5. (e) we may charge the costs of recovering the Vehicle to your nominated payment method.

11.4 No Refund on Termination

If we terminate the Rental Agreement under clause 11.1, no refund of rental charges or bond will be provided. If we terminate under clause 11.2 after a cure period, a pro-rata refund of unused rental days may be provided at our discretion, less any costs incurred due to the breach.

12. Limitation Of Liability

12.1 Exclusion of Consequential Loss

To the maximum extent permitted by law, EZ Rentals is not liable for any:

  1. (a) loss of income, revenue, or profit;
  2. (b) loss of business opportunity or goodwill;
  3. (c) business interruption or loss of productivity;
  4. (d) loss, damage, or theft of personal property left in the Vehicle (including but not limited to luggage, electronic devices, jewellery, and documents);
  5. (e) indirect, consequential, special, or punitive loss or damage; or
  6. (f) any claim arising from your failure to comply with these Terms and Conditions or the Rental Agreement.

12.2 Australian Consumer Law Carve-Out

Nothing in these Terms and Conditions excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (ACL) or any other applicable law, to the extent that such exclusion, restriction, or modification would be void, illegal, or unenforceable. To the extent that the ACL applies, our liability for breach of a consumer guarantee is limited, at our option, to:

  1. (a) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or
  2. (b) in the case of services, the supplying of the services again or the payment of the cost of having the services supplied again.

12.3 Liability Cap

Subject to clause 12.2, our total liability to you for any claim arising out of or in connection with the Rental Agreement, whether in contract, tort (including negligence), statute, or otherwise, is limited to the total amount paid by you for the rental in question.

12.4 Indemnity

You indemnify and hold harmless EZ Rentals, its directors, employees, agents, and insurers from and against all claims, losses, damages, liabilities, costs, and expenses (including legal costs on a full indemnity basis) arising out of or in connection with:

  1. (a) your use of the Vehicle;
  2. (b) any breach of these Terms and Conditions or the Rental Agreement;
  3. (c) any injury to or death of any person or damage to property caused by your use of the Vehicle; and
  4. (d) any claim by a third party arising from your conduct during the Rental Period.

13. Governing Law And Jurisdiction

13.1 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Australia, and specifically the laws of the state or territory in which the Rental Commencement occurs. If any provision of these Terms and Conditions is invalid or unenforceable under the laws of any state or territory, it will be read down or severed to the extent necessary to make it valid and enforceable, without affecting the validity of the remaining provisions.

13.2 Jurisdiction

You and EZ Rentals submit to the exclusive jurisdiction of the courts of the state or territory in which the Rental Commencement occurs, and the Federal Court of Australia, for the determination of any dispute arising out of or in connection with these Terms and Conditions or the Rental Agreement.

13.3 National Operation

Specific state or territory requirements, including compulsory third party insurance, licensing, road rules, and local restrictions, may apply depending on the location of Rental Commencement and use of the Vehicle. You are responsible for complying with all applicable laws and regulations during the Rental Period.

14. Payment Terms

14.1 Payment Methods

We accept the payment methods displayed or approved at the time of booking. Any card or payment surcharge will be disclosed before payment and will not exceed the reasonable cost incurred by EZ Rentals in accepting that payment method.

14.2 Timing of Payment

All rental charges, bond, and any optional products (including LDW) must be paid in full at Rental Commencement. No Vehicle will be released until payment is confirmed.

14.3 Currency

All amounts are in Australian Dollars (AUD) and include GST where applicable.

14.4 Additional Charges

Any additional charges incurred during or after the Rental Period (including but not limited to tolls, infringements, damage, cleaning, and fuel) will be charged to your nominated payment method within 14 days of the charge being incurred or identified, whichever is later.

14.5 Late Payment

If you fail to pay any amount when due, we may:

  1. (a) charge late payment interest at the rate of 12% per annum, calculated daily from the due date until payment is received;
  2. (b) charge a late payment fee of $25.00 per reminder issued;
  3. (c) refer the debt to a collection agency, and you will be liable for all collection costs; and
  4. (d) suspend your eligibility for future rentals until the debt is paid in full.

14.6 Disputed Charges

If you dispute any charge, you must notify us in writing within 14 days of the charge being applied to your payment method. We will investigate the dispute and provide a written response within 14 days. Pending resolution, we will not charge additional interest on the disputed amount.

15. Cancellation, No-Show, And Refunds

15.1 Cancellation by You

You may cancel your booking subject to the following conditions:

  1. (a) Cancellation 48 hours or more before Rental Commencement: full refund less a $50.00 administration fee;
  2. (b) Cancellation between 24 and 48 hours before Rental Commencement: 50% refund of rental charges;
  3. (c) Cancellation less than 24 hours before Rental Commencement: no refund.

15.2 No-Show

If you fail to collect the Vehicle within 2 hours of the agreed Rental Commencement time without prior notice, the booking will be treated as a no-show. No refund will be provided, and the full rental charges will be forfeited.

15.3 Cancellation by EZ Rentals

We may cancel your booking before Rental Commencement if:

  1. (a) the Vehicle becomes unavailable due to mechanical failure, accident, or Force Majeure Event;
  2. (b) we are unable to verify your eligibility or payment method; or
  3. (c) we reasonably believe that providing the Vehicle would create an unacceptable risk.

In the event of cancellation by us under clause 15.3(a), you will receive a full refund of all amounts paid. In the event of cancellation under clause 15.3(b) or (c), our standard cancellation fees apply.

15.4 Early Return

If you return the Vehicle before the end of the agreed Rental Period, no refund of unused days will be provided unless you have purchased a specific "flexible return" product, if offered.

15.5 Force Majeure

If a Force Majeure Event prevents us from providing the Vehicle or prevents you from collecting the Vehicle, we will provide a full refund of all amounts paid or, at your option, a credit note valid for 12 months from the original Rental Commencement date.

16. Dispute Resolution

16.1 Internal Complaint

If you have a complaint or dispute, you must first contact our customer service team in writing at support@ezrentals.com.au. We will acknowledge your complaint within 2 Business Days and provide a written response within 14 Business Days.

16.2 External Dispute Resolution

If we cannot resolve your complaint through our internal process, you may refer the matter to the Australian Financial Complaints Authority (AFCA) if your complaint relates to an insurance or financial services matter, or to the relevant state or territory fair trading or consumer affairs office for all other matters.

16.3 Litigation

Neither party may commence court proceedings in relation to any dispute arising out of these Terms and Conditions until the dispute resolution process in clauses 16.1 and 16.2 has been exhausted, except where urgent injunctive relief is sought or where the dispute relates to non- payment of amounts clearly due and undisputed.

17. Privacy And Data Protection

17.1 Privacy Policy

Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is available at https://www.ezrentals.com.au/legal/privacy-policy and forms part of these Terms and Conditions.

17.2 Consent to Data Use

By entering into a Rental Agreement, you consent to our collection, use, and disclosure of your personal information as described in the Privacy Policy, including disclosure to:

  1. (a) our insurers and loss adjusters for claims purposes;
  2. (b) debt collection agencies for overdue amounts;
  3. (c) government authorities and law enforcement as required by law;
  4. (d) toll operators for toll administration; and
  5. (e) credit reporting agencies for credit checks and default listing.

17.3 Marketing Communications

With your consent (which may be withdrawn at any time), we may send you marketing communications about our products and services. You may opt out by clicking the unsubscribe link in any marketing email or contacting us at support@ezrentals.com.au.

18. General Provisions

18.1 Entire Agreement

These Terms and Conditions, together with the Rental Agreement and Privacy Policy, constitute the entire agreement between you and EZ Rentals and supersede all prior negotiations, representations, and agreements.

18.2 Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, it will be severed to the extent necessary to make it valid and enforceable, and the remaining provisions will continue in full force and effect.

18.3 Waiver

No waiver of any breach of these Terms and Conditions will be effective unless in writing signed by the party granting the waiver. A waiver of any breach will not be deemed a waiver of any subsequent breach.

18.4 Assignment

You may not assign or transfer your rights or obligations under the Rental Agreement without our prior written consent. We may assign our rights and obligations without your consent.

18.5 Notices

All notices under these Terms and Conditions must be in writing and sent to the email or postal address last notified by each party. Notices sent by email are deemed received 24 hours after sending, and notices sent by post are deemed received 5 Business Days after posting.

18.6 Variation

We may vary these Terms and Conditions from time to time. The version applicable to your rental is the version current at the date of your booking. We will publish the current version on our website and provide a copy upon request.
